Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the HalalNearby website and services at halalnearby.com(the “Service”), operated by IKESON Technology Solutions (“HalalNearby,” “we,” “us,” or “our”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility & accounts

You must be old enough to form a binding contract to use the Service. When you create an account, you agree to provide accurate information and to keep your login credentials secure. You are responsible for activity that occurs under your account.

2. License to use the Service

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use. You may not scrape, bulk-download, resell, or re-publish our listings or data, attempt to break account or tenant isolation, reverse-engineer the Service, or circumvent our bot-protection or rate limits.

3. Your content & the license you grant us

You retain ownership of the reviews, photos, confirmations, reports, and submissions you post (“User Content”). By posting User Content, you grant us a worldwide, royalty-free, non-exclusive license to host, display, reproduce, and distribute it in connection with operating and promoting the Service.

You represent that you own or have the rights to the content you post (including photos), and that it does not violate anyone’s rights or the law. We may moderate, edit, refuse, or remove User Content, and we may act on community reports. We have no obligation to monitor content but reserve the right to do so.

4. Owner listings & claims

Business owners may claim and manage their listing subject to verification. A claim may be reviewed, revoked, or suspended if we believe it is inaccurate or abused. Owners are responsible for the accuracy of information they provide.

5. Halal status disclaimer

HalalNearby publishes halal confidence signals about third-party restaurants. These signals are informational and are not a certification or guarantee of halal compliance. Our Halal Accuracy Disclaimer is incorporated into these Terms by reference, and you agree to it. Always confirm halal status directly with the restaurant before relying on it.

6. Disclaimers of warranty

The Service, including all listings, halal signals, hours, links, maps, and third-party content, is provided “as is” and “as available” without warranties of any kind, whether express or implied, including accuracy, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law.

7. Limitation of liability

To the fullest extent permitted by applicable law, HalalNearby and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your reliance on listings or halal signals. Nothing in these Terms limits liability that cannot be limited under Ontario or Canadian consumer-protection law.

8. Indemnification

You agree to indemnify and hold harmless HalalNearby from claims, losses, and expenses arising out of your User Content, your use of the Service, or your breach of these Terms, to the extent permitted by law.

9. Third-party services

The Service may include or link to third-party content and services (such as Google sign-in, maps, and restaurant information) provided “as is.” We are not responsible for third-party services or content.

10. Termination

We may suspend or terminate your access to the Service at any time for conduct that we believe violates these Terms, harms other users, or harms the Service.

11. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. The courts of Ontario will have jurisdiction over any disputes, subject to applicable law.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Continued use of the Service after changes means you accept the updated Terms.
